Adding a Power of Attorney

Why complete a power of attorney to designate an attorney-in-fact?

A power of attorney is a document that can be used to designate an attorney-in-fact who would be authorized to act on an individual’s behalf. For example, an attorney-in-fact would be authorized to receive information about your account(s), request transactions, receive account statements, and initiate beneficiary changes.

There are two types of power of attorney that can be designated on your account(s):

• Durable: The power of attorney will continue even if the account owner becomes incapacitated.
• Nondurable: The power of attorney will terminate at such time that we receive notice of the account owner’s incapacitation.
  

Note that an attorney-in-fact cannot be added to accounts with the registration of an estate, custodian, or guardianship.

If the power of attorney is being added to a trust account, you must enclose copies of the title page, the signature page, and the section of the trust document that allows for the appointment of an agent.

What to do if the owner cannot sign the form:

If the account owner cannot sign the Power of Attorney (POA) form, you must provide a photocopy of the legal power of attorney papers, signed by the attorney-in-fact, dated, and notarized within the past 60 days.

For durable POA, the following certification must be typed or written on the copy of the POA papers:
I hereby certify that this document is a true and complete copy of the original power of attorney, still in full force and effect, and the maker is alive.

For nondurable POA, the certification must state the following:
I hereby certify that this document is a true and complete copy of the original power of attorney, still in full force and effect, and the maker is alive and competent.

When completing the Power of Attorney (POA) form, acceptable examples of the attorney-in-fact's signature (signing on behalf of the account owner) are:

• Jane Smith, attorney-in-fact for John Doe
• Jane Smith, POA for John Doe
